Julien James Auzan – JAYJAY Studio is a sole proprietorship registered with the IDE registry and the AVS compensation fund of the Canton of Fribourg, but not registered with the commercial registry.
1 – Rates / Service Prices
Service prices are listed in Swiss francs, as net amounts and including tax (not subject to VAT), and are guaranteed. The rates listed for services are indicative of the basic cost of those services and are fixed for the current calendar year.
When a service request is submitted, a no-obligation quote is prepared following a discussion to jointly identify the requirements, in order to best assess the scope of work required as well as the necessary image usage licenses.
As long as the service remains within the defined scope, the quoted price will be honored. If this scope is exceeded, the photographer will contact you in advance to adjust the price to reflect the new requirements. However, the photographer will cover the full cost of any additional work as long as it remains within the scope originally defined.
2 – Availability
The service is guaranteed to be provided on the scheduled date, provided the photographer is not unable to work. If the photographer is unable to work, a new date will be set.
3 – Payment Terms
Payment in full at the end of the service, payable in cash, via TWINT, debit card, or credit card (with a 5% discount).
Invoice due within 30 days (or another timeframe specified in advance), payable by bank transfer.
An automatic reminder is sent on the due date at no charge. A second reminder is sent 10 days after the due date. If no payment arrangement has been requested, reminder fees starting at CHF 20.00—which can accumulate—will apply.
If no contact has been made after 60 days of delinquency, legal proceedings may be initiated. In the case of a website, it may be deactivated until the invoice is paid. After 120 days, the website may be completely deleted, resulting in the automatic termination of the contract.
4 – Delivery
The delivery commitment is established in advance (within 4 business hours following the service) and is guaranteed as long as the photographer is able to work. If the photographer is unable to work, a new deadline will be set.
5 – Refund
The service is non-refundable once it has been performed and has complied with the predefined scope of work. If you are dissatisfied with the service, a new version may be agreed upon, with or without additional charges, depending on the circumstances.
6 – Data Protection
All personal data is considered confidential. The information necessary for billing purposes is processed electronically using accounting software (Invoice2Go) used exclusively by the photographer.
The images produced are stored in Switzerland with the hosting provider Infomaniak and are accessible only to the client and the photographer.
7 - Copyright and Right of Publicity
The images created by the photographer are protected by copyright. The photographer must be credited whenever his or her work is used, unless otherwise agreed upon in advance.
The original files (RAW photo files and video rushes) are the property of the photographer and may not be shared (particularly for the purpose of processing or editing by a third party), except in the case of a special agreement within the framework of a large-scale commercial project.
The photographer is permitted to use the images created for self-promotion (printed and digital portfolios). The recognizable person must notify the photographer prior to the session if they do not wish to allow the photographer to use their image for self-promotion. After the session, the recognizable person may contact the photographer at any time to request that the image be removed.
In the case of promotional materials, particularly printed materials, the photographer agrees to obtain the consent of any recognizable person in advance.
Finally, with regard to images created as part of an event report, the person who is recognizable must contact the entity organizing the event.
8 – Governing Law and Jurisdiction
Swiss law shall apply, and any dispute shall be heard by the Sarine District Court in the canton of Fribourg, Switzerland.
